TERMS OF SALE
I) Conclusion and termination of sales contracts
These Terms and Conditions as well as individual terms of sale indicated with information about specific products represent an offer by www.gloryday.eu to conclude a Contract, and the user as a customer by registering, concluding an order or in another way determined by these Terms accepts the same, which is considered to have concluded a Contract between users and Gloryday according to the terms of sale set forth in these Terms.
The subject and commercial purpose of the Agreement is the purchase of a selected product or service via www.gloryday.eu with the payment of an appropriate fee – the price of that product and/or service. The contract is concluded by means of remote communication (Contract concluded at a distance) through: printed promotional messages with purchase order, telephone with and without human mediation, and the Internet.
The contract becomes effective and binding from the moment the user accepts the Gloryday offer in one of the following ways:
– by selecting payment and completing the order as a registered user of www.gloryday.eu,
– by selecting payment and completing the order via email received at info@gloryday.eu.
a) In the process of registering or creating a user account, the user is obliged to choose a name or names under which he will provide services and choose a security password and submit a valid e-mail address. All data required to register or create a user account must be true, and the use or use of other people’s data is expressly prohibited.
b) During registration, if you want to register through a Facebook account and want to comment and actively participate on our Facebook profile, Gloryday can use your full name, i.e. your Facebook account.
c) Registration or user account is created only for one person and it is not allowed to communicate information about registration or user account to third parties. The user is obliged to keep information about his security password and user account. The use of someone else’s registration or user account is not allowed.
d) For violation of the provisions of the Terms and Conditions from this chapter, Gloryday reserves the right, at its discretion, to terminate the user’s registration or user account, without the obligation to compensate the user for any cost or damage.
e) Registration (which includes payment for the product and/or service) is considered to have concluded a contract between Gloryday3 and the user as a customer.
f) The Agreement enters into force upon the user’s registration, i.e. from the day the user accepts the offer to enter into such an Agreement.
g) On the occasion of the conclusion of the Agreement, the user will be delivered: a confirmation of the concluded Agreement, i.e. a pre-contractual notice from Article 57, Paragraph 1 of the Consumer Protection Act (Official Gazette, No. 41/2014, 110/15), these Terms and the notice on the user’s right to unilateral termination of the Agreement with the form for unilateral termination of the Agreement from Article 61, paragraphs 1 and 2 of the Consumer Protection Act
h) The User can unilaterally terminate the Agreement within 14 (fourteen) days without giving a reason. The User does not have the right to unilaterally terminate the Agreement:
– if the service has been fully fulfilled for him, and the fulfillment began with his explicit prior consent and with his confirmation that he is aware of the fact that he will lose the right to unilaterally terminate the Agreement if the service is fully fulfilled for him,
– if the subject of the Agreement is sealed goods that are not suitable for return due to health or hygiene reasons, if they were unsealed after delivery,
– if the subject of the Contract is goods which, due to their nature, are inseparably mixed with other things after delivery.
In order for the user to be able to exercise the right to unilaterally terminate the Agreement, he must notify Gloryday of his decision to unilaterally terminate the Agreement before the expiration of the term, by an unequivocal statement sent by mail (to GGC GRUPA jdoo Druga Gupčeva 17a 10360 Sesvete), or by email to info@gloryday. eu , in which you will state your first and last name, address, phone number or email address, and you can also use the specified written form for unilateral termination of the Agreement.
Also, the user can electronically fill out and send the Form for unilateral termination of the Agreement, which is available on LINK, in which case Gloryday will send him a confirmation of receipt of the notice of unilateral termination of the Agreement by electronic mail without delay.
The deadline for unilateral termination of the Agreement is 14 (fourteen) days from the day when the goods that are the subject of the Agreement were handed over to the user or a third person designated by the user, who is not the carrier, or, in the case of a service, from the conclusion of the Agreement.
In the event that the conditions for unilateral termination of the Agreement are fulfilled, the funds received from him will be refunded, not including delivery costs, without delay, and at the latest within 14 (fourteen) days from the day when Gloryday, i.e. www.gloryday.eu receives the user’s decision on unilateral termination of the Agreement. The refund will be made in such a way that the user does not bear any costs in relation to the refund. Gloryday can refund the money only after the goods have been returned to it and examined in what condition it was returned, considering the fulfillment of the conditions for the right to unilateral termination of the Agreement.
The user is obliged to hand over the goods or send them to the address GGC GRUPA jdoo Druga Gupčeva 17a 10360 Sesvete, without undue delay, and in any case no later than within 14 (fourteen) days from the day when Gloryday, i.e. www.gloryday.eu, sent its decision on unilateral termination of the Agreement. The user bears the direct costs of returning the goods. Shipments sent by cash on delivery will not be collected.
Before terminating the Agreement, the User is requested to send an e-mail to info@gloryday.eu so that the procedure for returning the goods can be explained to him.
The user is responsible for any decrease in the value of the goods resulting from the handling of the goods, except for that which was necessary to determine the nature, characteristics and functionality of the goods. In case of damage to the original packaging, the refund amount will be reduced by a percentage corresponding to the value of the goods. In that case, you will be notified.
If, at the user’s request, the execution of the service began during the term for unilateral termination of the Agreement, the user is obliged to pay Gloryday an amount commensurate with what was delivered by the time the user notified Gloryday of the unilateral termination of the Agreement.
II) Conditions and purchase procedure
The main characteristics of the product, the method of use, prices, special offers and benefits, payment and delivery methods refer to those that are valid at the time the order is placed. The above data will be indicated with each product.
The price of the product and the delivery service, which includes the amount of VAT, are visible in the shopping cart before the order is placed. The cost of delivery may also be visible on some other parts of the page. All information about the purchase confirmation based on the electronic order will be delivered to the customer’s e-mail address specified in the registration/order process or in the shopping cart when entering data when concluding the order. All prices are expressed in euros. The same price of all items will be indicated on the invoice that will be delivered by e-mail.
If the customer does not receive the order confirmation notification, there is a possibility that he entered his e-mail address incorrectly. In this case, we ask the customer to contact us at: info@gloryday.eu so that our Customer Service can assist in the realization of the order.
III) Delivery and terms of delivery
a) the cost of delivery is calculated automatically when you purchase the product and you are issued an invoice containing the price of the purchased products and the cost of delivery
b) the cost of delivery in the territory of the Republic of Croatia is € 4.50 for payment by direct bank transaction, while for payment by cash on delivery it is € 4.50. c) the delivery term for products, which are stated to be in stock, in the entire territory of Croatia is 3-5 working days from the day of dispatch, in accordance with the deadlines of delivery services.
d) in the event of a change in the delivery date or any other important circumstances for the execution of the order, the customer will be notified immediately by our customer service.
IV) Complaints and objection
The ordered products are packed in such a way that they are not damaged by normal handling during transport/delivery. We pack and additionally protect each of your products with specialized transport packaging.
The buyer is obliged to inspect the packaging of the shipment when taking it over. If the packaging of the shipment has visible damage/flaws, we recommend that the customer refuse to accept it, because there is a possibility that the product inside such packaging is damaged. Upon refusal of receipt, the delivery service will complete a Damage Report and return the shipment to Gloryday, noting that the shipment contains a defect.
Complaints regarding the lack of products and all other objections can be made in writing via email info@gloryday.eu. In the event of a justified complaint, it is possible to terminate the contract with a refund of the amount paid or exchange for the same product or another product of the same value, i.e. with a surcharge or refund of part of the funds if necessary. If it is about damage and/or malfunction of the delivered goods, the buyer should send a photo of the said complaint to info@gloryday so that it can be accepted based on subsequent physical evidence.
Gloryday collects the advertised damaged, defective or wrongly delivered goods at its own expense if it is determined that the complaint is justified and that the customer did not affect the defectiveness, damage or any lack of the goods. In the case of a justified complaint within the terms specified by the Law on Obligatory Relations, the entire cost of replacing the product with a new one is entirely borne by Gloryday.
In the event of a dispute regarding the justification of the complaint and/or the authenticity of the product, and if the customer, based on a subjective assessment, believes that he did not receive an adequate product and/or service, it is customary in business practice to report the case to one of the competent institutions.
Competent and official bodies then perform all the necessary checks to determine correctness and compliance with applicable laws. Upon making a decision, both parties, both the buyer and the seller, receive a specified record. Such an official record of an independent body is considered authoritative and sufficient to end the complaint procedure.
V) Method and procedure of payment
Payment of the product price and delivery costs can be made in one of the following ways:
a) Payment in cash – cash on delivery. When picking up the shipment, the full amount indicated in the invoice is paid to the delivery person, including the cost of delivery.
In the event that the Buyer orders the Product and refuses to receive it, i.e. pay cash on delivery, the Seller has the right to request reimbursement from the Buyer for delivery costs and own handling costs (€10 for all shipments within the territory of the Republic of Croatia). The customer gives his consent to the stated obligation by completing the order on gloryday.eu
